To comment on a project:
• Submit written comments to PDS at the address below. All comments received prior to issuance of a department decision or recommendation will be reviewed. To ensure that comments are addressed in the decision or recommendation, they should be received by PDS before the end of the published comment period.
• Comments, on a project scheduled for a hearing before the hearing examiner, may be made by submitting them to PDS prior to the open record hearing.
• PDS only publishes the decisions as required by Snohomish County Code. Persons will receive notice of all decisions that they have submitted written comment on, regardless of whether or not they are published.
• You may become a party of record for a project by: 1. submitting original written comments and request to become a party of record to the county prior to the hearing, 2. testifying at the hearing or 3. entering your name on a sign-up register at the hearing. NOTE: only parties of record may subsequently appeal the hearing examiner’s decision or provide written or oral arguments to the county council if such an appeal is filed.
To appeal a decision:
• Department decisions (including SEPA threshold determinations): submit a written appeal and the $500 filing fee to PDS prior to the close of the appeal period. Refer to SCC 30.71.050(5) for details on what must be included in a written appeal.
• A SEPA appeal also requires that an affidavit or declaration be filed with the hearing examiner within seven days of filing the appeal, pursuant to SCC 30.61.305(1).
• Hearing examiner decisions issued after a public hearing are appealable as described in the examiner’s decision. Notice of those decisions is not published. You must have submitted written comments to PDS or written or oral comments at the public hearing in order to appeal a hearing examiner’s decision.
• Building and Grading applications associated with a Single Family Residence are not subject to the County’s appeal process. To file a judicial appeal in Superior Court, refer to WAC 197-11-680 and RCW 43.21C.075.

American Tower Corporation is proposing to modify an existing telecommunications tower located at 11228 34th Avenue NE, Tulalip, Snohomish, Washington.

This property is zoned for commercial use. American Tower proposes to extend the existing 105-foot tower to a height of 142 feet. The proposed expansion will facilitate the future addition of twelve panel antennas located at a height of 142 feet. Please note that there are two existing telecommunications tower facilities located at the property. The tower proposed to be modified is located on the northern portion of the property. American Tower Corporation seeks comments from all interested persons on the impact of the tower on any districts, sites, buildings, structures, or objects significant in American history, architecture, archaeology, engineering or culture, that are listed or eligible for listing in the National Register of Historic Places.

Pursuant to authority under Section 104 of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA or Superfund; Title 42, United States Code, section 9604) and Federal Executive Order 12580, on February 1, 2008, Mt. Baker-Snoqualmie National Forest Supervisor Y. Robert Iwamoto initiated a CERCLA response action to address removal actions at the Big Four Ice Caves Bridge on the Mount Baker-Snoqualmie National Forest, Snohomish County, WA.
This response action is consistent with the National Oil and Hazardous Substance Pollution Contingency Plan (NCP) as found at Title 40, Code of Federal Regulations, Part 300. The Administrative Record File for this response is located at the Mt. Baker-Snoqualmie National Forest Supervisor’s Office, Everett, WA; and is available for public inspection during regular business hours.
The Forest Service will accept written comments for 30 calendar days from the date of this notice and will respond to significant comments. Master Plan Update
City of Marysville Comprehensive Plan and Development Regulations Update for the Downtown Plan Master Plan and Planned Action
Determination of Significance
and Request for Comments
on Scope of EIS
Description of Proposal:
The Proposed Action is a Master Plan and Planned Action for the Downtown Vision area, a portion of Planning Area 1 of the City’s neighborhood planning areas.
The Master Plan/Planned Action will emphasize three major objectives including enhancing the setting for development consistent with the Comprehensive Plan and Downtown Vision Plan, enhancing environmental quality (notably stormwater management), and upgrading infrastructure (circulation and utilities).
Catalyst projects, including infrastructure and public facilities, will be considered within the Planned Action project approach.
Location: The planning area is approximately 182 acres and bounded by 8th Street to the north, Ebey Slough to the south, Alder Avenue to the east, and Interstate 5 to the west.

Determination of Significance (Supplemental EIS required). The lead agency has determined this proposal is likely to have a significant adverse impact on the environment. A supplemental environmental impact statement (SEIS) is required under RCW 43.21C.030 (2)(c) and will be prepared. The SEIS will contain new information and analysis, but will also utilize data and analysis contained in previous documents or studies, any of which may be adopted or incorporated by reference as appropriate, according to the SEPA rules. An environmental checklist indicating likely environmental impacts can be reviewed at our offices.
SEPA/GMA Integration:
The City of Marysville has determined that this proposal is a major action under SEPA and therefore, an Environmental Impact Statement (SEIS) will be prepared concurrent with the development of the Master Plan. The Planned Action SEIS and Master Plan documents will combine the processes and provide supporting analysis required under both the Washington Growth Management Act (GMA) and the State Environmental Policy Act (SEPA) as described under Washington Administrative Code Section 197-11-210 through 197-11-235.
Phased Environmental Review:
Environmental review for the proposal is being phased pursuant to the provision of WAC 197-11-060(5). Phasing allows environmental review to focus on issues that are ready for decision while deferring consideration of items not ready for action. Prior phases of environmental review (DEIS, FEIS) focused on the Comprehensive Plan update, and development regulations for the city at large. The current phase of environmental review encompasses a supplemental EIS for the Downtown Vision area and Planned Action with anticipated development for the master plan area. Subsequent phases of environmental review may include additional supplemental EISs, Declarations of Non-significance, and/or addenda for the adoption of land use code amendments.
Scoping. Agencies, affected tribes, and members of the public are invited to comment on the scope of the supplemental EIS (SEIS). Comments may be made on the probable significant adverse impacts and scope of the SEIS. Comments may be submitted in writing to the address indicated below. The deadline for scoping comments is 5:00 p.m., May 5, 2008.
